Apple Asserts Trademark Rights Over Its Iconic Apple Logo, Sparking Controversy with Swiss Fruit Union (FUS)

In a recent report by The Times and other leading publications, it has come to light that Apple, the tech giant renowned for its iconic bitten apple logo, is embroiled in a legal dispute with the Swiss Fruit Union (FUS), a collective of Swiss fruit growers. Apple has demanded that FUS, which features a logo bearing a similar resemblance, change its logo, leading to significant controversy.

According to reports, Apple, which has been using the distinct image of a partially eaten apple as its logo, is claiming exclusive rights over its commercial use. The company has filed a lawsuit against FUS, which has a rich history spanning 111 years, in an attempt to protect its trademark.

FUS, established to promote the interests of fruit farmers within Switzerland, has adopted a logo featuring a red apple with a white cross in the upper right corner.

Although Apple previously applied for intellectual property rights for its apple image with the Swiss Federal Institute of Intellectual Property (IPI) in 2017, its request was denied. As a result, Apple initiated legal proceedings in April this year, seeking trademark protection from the Swiss Federal Administrative Court.

Should the court rule in favor of Apple, FUS may be compelled to modify its existing logo.

Responding to the allegations, Jimmy Marietos, a director at FUS, criticized Apple, stating, "The use of apple imagery in the media has the potential to impact everyone," further asserting, "Apple did not invent the apple. We (FUS) have been around for 111 years, and the apple has existed for thousands of years."

Michel Jacquard, a prominent technology law attorney in Lausanne, Switzerland, expressed skepticism about pursuing an imperialistic strategy, questioning its potential benefits for companies like Apple.

The Independent, a British news outlet, reported that Apple has actively pursued trademark protection for its logo in various countries, including Armenia, Israel, Japan, and Turkey.

According to the Technology Transparency Project (TTP), a nonprofit organization, Apple has filed more trademark applications between 2019 and 2021 than a combined total of Amazon, Facebook, Google, and Microsoft (MS). These endeavors demonstrate Apple's commitment to safeguarding its brand identity.

As the legal proceedings unfold, it is expected that the court's decision will be reached within a few months.
